Antitrust Litigation

Because even the most informed counseling cannot always avert litigation, the firm has developed an elite antitrust litigation practice, with a proven record of success. The firm’s antitrust litigators represent corporations, individuals and associations in cases involving claims of price fixing, market allocation, actual or attempted monopolization, price discrimination, resale price maintenance, refusals to deal, information exchanges, improper dealer terminations, and other alleged antitrust violations. We have also litigated private and public challenges to proposed mergers and acquisitions.

In the United States, we have handled hearings, trials and appeals in federal and state courts in every corner of the country, as well as before administrative law judges at the Federal Trade Commission and a variety of regulatory agencies. The firm represents clients in litigation with the U.S. Government, as well as with private parties, and in connection with criminal as well as civil proceedings. We are able to mobilize quickly to support or respond to applications for preliminary injunctions, as well as to staff major government investigations and complex, prolonged multi-district class actions.

Like our trial work, the firm’s antitrust-related Appellate Practice in the United States is national in scope. Our lawyers have represented clients before the U.S. Supreme Court, federal courts of appeals, state supreme courts and other appellate bodies. As a result of our nationally recognized Supreme Court practice, the firm is frequently asked to represent a party on an appeal when another firm handled the proceedings in the trial court. Indeed, the firm is often retained to handle an important trial when the client believes that there is a chance that an issue might be appealed.

In the European Union, our lawyers have an impressive track record representing clients before the General Court and Court of Justice of the EU in Luxembourg in appeals of decisions of the European Commission in merger control, antitrust and state aid cases. We also assist clients in civil antitrust litigation throughout Europe and in arbitrations involving European antitrust issues.
