Energy Regulatory


Sidley has a diversified Energy Regulatory practice, representing clients in the electric utility industry and in the transportation, by pipeline, of natural gas, crude oil and petroleum products. We practice before the Federal Energy Regulatory Commission, state regulatory commissions, federal and state appellate and lower courts, as well as the U.S. Departments of Transportation, Energy and State. Sidley lawyers represent major cross-border oil and gas pipeline projects with respect to all aspects of project development, federal and state permitting and right-of-way acquisition. Sidley lawyers also represent major electric utilities and other electric industry participants in litigation and regulatory proceedings concerning electric transmission and the operation of electric power markets nationwide. We also assist clients in compliance matters and investigations related to federal statutes and regulations pertaining to energy. Further, we provide corporate, finance and regulatory due diligence advice with respect to the acquisition and disposition of energy assets.

In light of the enhanced enforcement and penalty authority that Congress granted FERC in the Energy Policy Act of 2005, a growing area in which clients have turned to Sidley lawyers involves representation in FERC enforcement matters. Our clients in such matters have covered a broad spectrum, ranging from a closely-held (private) energy producer/marketer to a major financial services firm engaged in energy transactions.
