ERISA Litigation


Sidley’s national ERISA Litigation group, working with our firm’s Employee Benefits lawyers, offer clients a team well versed in the full range of ERISA issues as well as in the complexities of high-profile class action litigation. We have represented employers, pension plans, board members, trustees, administrators, broker-dealers and other clients in trial, bankruptcy and appellate courts throughout the country, including the United States Supreme Court. Our clients include AT&T, AON Corporation, Bank of America, Exelon Corporation, Pfizer, Southern California Gas Company, Tribune Company and other public companies in cash balance plan litigation, 401(k) class actions and stock drop cases.

Recent significant victories in cases in which Sidley served as counsel include:

  • Sidley represented Southern California Gas Company in obtaining the dismissal of a class action lawsuit alleging that the company’s cash balance plan violated ERISA’s age discrimination, backloading and 204(h) notice provisions, as well as state law.   • Sidley obtained the first substantive legal ruling in the wave of recently filed 401(k) mutual fund “revenue sharing” cases, striking the plaintiffs’ claim for investment losses.
  • Sidley successfully represented Tribune Company in obtaining the dismissal of all claims of a class action lawsuit filed by participants in the company’s 401(k) plans alleging that the defendants violated their fiduciary duties under ERISA by improperly including the company stock fund as an investment option.
