RUSSELL L. JOHNSON represents clients in intellectual property disputes and other commercial litigation. He has extensive experience in patent, trade secret, antitrust, unfair competition and breach of contract cases. He has served as lead counsel in more than 30 cases involving such diverse technology as software programming, semiconductors, computer hardware, medical devices, and cloning of antibodies. In addition, Mr. Johnson has counseled numerous individuals and companies regarding patent infringement, trade secrets, protection of intellectual property, and enforceability of non-competition agreements.
Representative Accomplishments:
Handling patent infringement cases involving such diverse technology as solid state disk drives, photolithography equipment, dry etch processes, wafer holders, lasers, scanning microscopes, active matrix LCDs, and DRAMs.
Has been lead counsel in over 20 trade secret cases including:
Obtaining a unanimous jury verdict that no trade secrets existed and that the plaintiff’s accusations constituted unfair competition.
Obtained a unanimous $1.4 million dollars jury verdict for misappropriation of software.
Favorably settled a trade secret and patent dispute involving a start-up biotechnology company and its founder over ownership of an invention for cloning antibodies.
Settled breach of contract cases for $450 million and $118 million against two major California power companies.
Major antitrust cases involving tie-in of computer hardware and software.
Represented computer companies in suits by users over alleged computer system problems.
Appointed Special Master in a trade secret case by the Santa Clara County Superior Court.
