JAY T. JORGENSEN is a partner and litigator in the Washington, D.C., office. His practice involves representing individuals and corporations in all phases of complex civil and criminal litigation. Mr. Jorgensen has represented pharmaceutical and food production companies in criminal and qui tam cases at every stage of development, from undercover and internal investigations to grand jury proceedings to trial. Mr. Jorgensen’s practice has also included civil and criminal appeals for individuals and businesses before numerous federal circuit courts and the United States Supreme Court.

Prior to joining the firm, Mr. Jorgensen served as a law clerk to William H. Rehnquist, Chief Justice of the United States Supreme Court, and Judge Samuel A. Alito, Jr., at the United States Court of Appeals for the Third Circuit.

Representative Engagements

  • United States v. Tyson Foods, Inc. — Member of trial team representing company in jury trial on 36 count Indictment charging conspiracy to violate federal immigration laws and seeking criminal forfeiture of over $100 million. Acquittal on all counts.
  • Pickett v. IBP — Member of trial team representing company in jury trial involving claims of anti-competitive conduct by defendant meat processor in connection with the purchasing of fed cattle. Judgment as a matter of law entered for defendant IBP. Also member of appellate team that secured favorable rulings at the U.S. Court of Appeals for the Eleventh Circuit and the Supreme Court.
  • In separate representations, represented four major pharmaceutical manufacturers in internal investigations and state and federal government inquiries regarding allegations of improper sales and marketing practices.
  • Representing two major pharmaceutical manufacturers in grand jury proceedings.
  • Utah v. Evans — Represented state and its leaders in trial court and appellate litigation over the 2000 census.
  • Madison v. Commonwealth of Virginia — Successfully represented individual in trial court proceedings regarding the constitutionality of a federal statute.
  • State of Oklahoma, et al. v. Tyson Foods, Inc., et al. — Representing food company in trial proceedings alleging significant environmental damages.
  • Securities Industry Association v. Utah — Successfully represented association in trial court proceedings challenging the constitutionality of a state law.
  • Weinstock v. Asian Development Bank — Successfully represented international development institution in civil litigation in the trial and appellate courts.
  • U.S. v. Glendale Federal Bank — Member of appellate team that successfully represented bank in various appeals defending $381 million damage award.
