Sidley Austin LLP invites you to a webinar on LCA Compliance
On March 12th, the Sidley Immigration practice will hold a web seminar for clients and friends of the firm to address how employers can best comply with the Labor Condition Application (LCA) requirements. Each H-1B petition submitted to the U.S. Citizenship and Immigration Services must be accompanied by an LCA (Form ETA 9035) certified by the Department of Labor. The LCA is designed to provide a measure of protection for the wages and working conditions of U.S. workers similarly employed in the area of employment as the H-1B worker. By signing and filing the LCA, an employer is making several attestations related to the H-1B worker’s work environment.
In addition to making the attestations on the LCA, H-1B employers are responsible for maintaining certain documentation to support the attestations made. The supporting documentation must be made available for public inspection and is known as the public access file. Designed for in-house legal and human resources professionals, the presentation will provide an overview of the documentation required for the LCA public access file and will also address a number of important issues related to LCA Compliance, including:
