Join The Brattle Group, Creel and Sidley for a discussion on recent developments of the Government of Mexico’s Ministry of Energy (Secretaría de Energía, or SENER) that may impact investments in the power sector. Issued on May 15, 2020, SENER’s Order for the Reliability, Safety, Continuity and Quality Policy in the National Electric System (the Order) modifies Mexico's energy policy considerably. Notably, and perhaps problematically, the Order establishes a new criterion of "reliability" for the supply of electric energy. Its purported purpose is to ensure consistency and control in the frequency and voltage of power plants, though critics say there are many legal deficiencies and that it raises important questions concerning renewable generation’s non-discriminatory and competitively neutral access to the Mexican grid, principles at the heart of the 2013 Energy Reform that created a competitive wholesale electricity market.
This webinar will explore these issues and more, including whether the new energy policy:
- discriminates against the generation of electricity from renewable sources to favor CFE-controlled generation sources
- encroaches on the scope of authority/jurisdiction of other governmental agencies and entities of the federal government
