Federal and state regulation of per- and polyfluoroalkyl substances (PFAS), a group of over 1,000 man-made chemicals that have been manufactured and used globally for over 70 years, continues to rise. PFAS have a number of properties, such as non-stick tendencies and heat and stain resistance, which has led to their use in a wide range of products, from carpet to non-stick cookware to firefighting foam. Because PFAS are persistent in the environment and challenging to remediate, a buyer of real property or a corporation impacted by PFAS can face significant cleanup liabilities and litigation risk.
