Sidley Secures Federal Circuit Win for Nevro Corporation

Sidley secured a victory for Nevro Corporation on May 29, 2020, when the U.S. Court of Appeals for the Federal Circuit affirmed a February 2019 Patent Trial and Appeal Board decision that invalidated all asserted claims of two of Appellant Boston Scientific’s patents related to spinal cord stimulation systems used to treat back pain. The Appeals Court decision voided 84% of the damages that Boston Scientific was seeking in the U.S. District Court for the District of Delaware. The District Court litigation was stayed pending final resolution of the inter partes reviews at issue.
