TODD SIMPSON divides his time between intellectual property transactional and litigation work and privacy and cybersecurity matters. His practice has spanned patents, trademarks, copyrights, and trade secrets. With this combination of experience, Todd is well positioned to advise technology-focused clients on a vast array of issues they face in today’s digitally connected world.
Todd’s transactional experience includes drafting and negotiating technology-related license, development, and distribution agreements, and helping resolve disputes that arise after execution. When unable to resolve the issue amongst the parties, Todd has initiated arbitrations under multiple arbitration regimes, including the International Chamber of Commerce (ICC) and United Nations Commission on International Trade Law (UNCITRAL). Todd has advised clients in numerous corporate deals, handling the technology-related valuation and risk assessments during investment and acquisition diligence.
An experienced litigator, Todd has participated in all stages of patent litigation, from pre-suit investigation to verdict. Todd has presented and crossed witnesses and has argued claim construction, summary judgment, and trial matters in federal court. His IP litigation cases involve a wide variety of technology areas, including FDA-regulated medical devices, consumer products, and internet technology.
Todd’s privacy work naturally complements his technology practice. Todd is a Certified Information Privacy Professional/US through the International Association of Privacy Professionals (IAPP). He has prepared incident response notices for clients relating to potential identity theft and the California Consumer Privacy Act (CCPA) and the Children’s Online Privacy Protection Act (COPPA) are a couple of the privacy statutory acts on which Todd has advised clients. Todd has also helped clients minimize the risk of facing state law privacy-related tort claims, such as the right of publicity.
