Sidley’s representation of Bayer in Bayer HealthCare LLC v. Baxalta Inc. has been named to The National Law Journal’s 2021 edition of the “Verdicts Hall of Fame” supplement.
Sidley won a major victory for Bayer in 2019 when a jury awarded a US$155 million verdict for infringement of Bayer’s patent on Factor VIII for treating hemophilia by Baxalta’s flagship product, Adynovate®. Sidley achieved another victory in March 2021 when the U.S. Court of Appeals for the Federal Circuit affirmed the jury verdict and rejected all of Baxalta’s challenges to the total award of $182 million that included supplemental damages. The Bayer verdict remains the largest standing biotech verdict in the U.S. District Court for the District of Delaware.
