Sidley secured a significant victory on behalf of client BioTelemetry (CardioNet) on April 17, 2020, when the U.S. Court of Appeals for the Federal Circuit in a precedential opinion reversed the decision of the District Court of Massachusetts, finding BioTelemetry’s patent to be eligible under 35 U.S.C. Section 101, step one of Alice, as directed to an improvement in remote cardiac monitoring technology and not to an abstract idea. This result was reported in Law360, Law.com, Bloomberg and Reuters, and the case has been cited in numerous subsequent court decisions, as well as included in numerous CLE presentations by various organizations.
