On January 17, 2020, the U.S. Court of Appeals for the Ninth Circuit ordered that a lawsuit alleging that plaintiffs were harmed by the United States government’s failure to stop climate change be dismissed for lack of standing, setting the stage for possible Supreme Court consideration of this issue. Although the decision was based on standing, separation of powers and other constitutional principles also played a factor.
