New Interim Guidance for Analyzing Greenhouse Gas and Climate Change Effects for Federal Actions

On January 9, 2023, the White House Council on Environmental Quality (CEQ) published its long-awaited interim guidance establishing uniform practices for assessing the scope of greenhouse gas (GHG) and climate change effects of proposed federal projects pursuant to the National Environmental Policy Act (NEPA). Although CEQ’s guidance is interim and subject to change, the guidance is effective immediately — meaning all new proposed actions are, and all pending proposed actions may be, subject to the guidance. However, interested states may challenge the guidance and seek to stay its implementation. CEQ is accepting comments on the interim guidance through March 10, 2023.
