Sidley Clinches Victory in HEC AD/CVD Investigations

January 30, 2026
Sidley achieved a significant victory for Lonza Greenwood LLC (Lonza), in the antidumping and countervailing duty (AD/CVD) investigations of imports of hard empty capsules (HECs) from Brazil, China, India, and Vietnam. After nearly two years of hard work by our team, the U.S. International Trade Commission voted in the affirmative that the U.S. HEC industry, including Lonza, is materially injured or threatened with material injury by reason of imports of HECs from Brazil, China, India, and Vietnam. With this decision, the U.S. Department of Commerce (DOC) will issue AD/CVD orders on these imports and instruct U.S. Customs and Border Protection to collect cash deposits on U.S. entries equal to the rates that were calculated by the DOC in its final determinations (AD rates up to 77.63% and CVD rates up to 10.67%).

The team was led by Shawn Higgins (Global Arbitration, Trade and Advocacy), Mark Guerrera (Commercial Litigation and Disputes), and Rajib Pal (Global Arbitration, Trade and Advocacy), and was supported by Justin Becker, Allison Reading, Ashlande Gelin, and Kornel Mahlstein (Global Arbitration, Trade and Advocacy).
