English High Court Confirms High Bar for Reliance on Apparent Authority

Giving judgment on May 24, 2019 in Phytos Stavrinides & Ors v Bank of Cyprus Public Company Limited1, John Kimbell QC (sitting as a Chancery Division Judge) confirmed that a person seeking to enforce a contract on the basis of an agent’s apparent or ostensible authority must overcome a high evidential burden. It also provides guidance on how the court will treat representations of authority to communicate decisions, referred to as “conduit authority.”
