Recent Investigations Highlight Federal Government’s Evolving Approach to Review of Privileged Communications Following Seizure

On May 28, the court overseeing the FBI’s seizure of cell phones and computers from Rudy Giuliani ordered the appointment of a special master to review the seized materials for privilege before they are provided to federal prosecutors. In light of Giuliani’s relationship with former President Donald Trump, these seizures presented a dramatic scene reaching the highest levels of government. The seizures also presented a significant legal problem—how to safeguard the privileges protecting communications between lawyer and client when the government seizes information—a problem that those accused of crimes (as well as those ultimately never accused of a crime) face every day. This Sidley Update focuses on options available to keep such privileged materials out of the hands of a prosecution team.
