U.S. Customs Modernization Act 2.0? Not Quite

On November 3, 2021, Sen. Bill Cassidy, R-La., a member of the Senate Finance Committee, circulated a draft of a proposed bill to modernize the 1993 Customs Modernization Act, commonly known as the “Mod Act.” Although Sen. Cassidy’s bill is titled “The Customs Modernization Act of 2021,” the draft does little to modernize U.S. customs law for most importers and instead focuses on expanding U.S. Customs and Border Protection (CBP) enforcement authority. Sen. Cassidy is accepting comments on the draft for two weeks, until November 20, 2021, and interested importers, trade associations, and e-commerce marketplaces should consider engaging with Congress on this draft.
