Washington, D.C., Council Delays Applicability Date of Noncompete Ban Until October 2022

After enacting one of the most expansive noncompete bans in the country, the D.C. Council (the Council) has once again delayed the applicability date for the new prohibition until October 1, 2022. Although the Ban on Non-Compete Agreements Amendment Act of 2020 (the Act) officially became effective March 16, 2021, it does not apply to employers until a later date. The Act was previously slated to become applicable on April 1, 2022. However, on March 1, the Council approved emergency legislation to further postpone the applicability date until October 1, 2022, while the Council’s Committee on Labor and Workforce Development considers legislation to amend the Act. By March 28, 2022, it should be known whether Mayor Muriel Bowser will either sign or take no action on the emergency bill, which would clear the way for the six-month extension of the Act’s applicability date to become law.
