The recent decision by Judge Victor Marrero of the U.S. District Court for the Southern District of New York in Borgese v. Baby Brezza Enterprises LLC, striking class allegations on the pleadings, raises questions about whether the motion to strike has been reinvigorated as a tool for class action defendants in the Second Circuit.
