Looking Ahead: DOJ Enforcement Priorities in 2025

In 2024, the Department of Justice (DOJ) continued to emerge from a pandemic lull and return to vigorous enforcement of the False Claims Act (FCA) — indeed in February, DOJ announced that it had issued a record 1,504 civil investigative demands in fiscal year 2023, and its current activity levels suggest another record-breaking year. In 2025, the healthcare industry can expect that DOJ will continue to prioritize investigating alleged fraud, waste, and abuse in the industry, with particular attention paid to private equity investment, the Anti-Kickback Statute (AKS), pandemic relief fraud, and cyber fraud.
