NICHOLAS CHIVERS’ practice focuses on cross-border compliance, investigations and regulatory matters relating to anti-bribery, fraud, sanctions and export controls, data privacy, employment, and competition.

Nicholas also has experience representing clients in high-profile regulatory and commercial disputes involving allegations of breach of directors’ duties, misleading and deceptive conduct, and breaches of contract and trustees’ duties.

Nicholas is fluent in English and speaks conversational French.

Representative Matters

Nicholas’ representative experience includes*:

  • Advising a Japanese medical product provider in relation to a cease and desist order issued by the Japan Fair Trade Commission for alleged violation of the Japanese Antimonopoly Act.
  • Acted successfully for six former non-executive directors of ASX-listed gambling and entertainment company in civil penalty proceedings brought by the Australian Securities and Investments Commission relating to breach of statutory directors’ duties concerning the company’s dealings with gaming junkets.*
  • Acted successfully for a material management business in concurrent appeal proceedings in the Federal Court of Australia relating to misleading and deceptive conduct and stay of proceedings for abuse of process.*
  • Acted for an ASX-listed company in a shareholder class action in the Federal Court of Australia relating to alleged breaches of continuous disclosure obligations.*
  • Acted for a consulting company in the Supreme Court of New South Wales in a dispute relating to the construction of contractual terms.*
  • Acted for executors, trustees, beneficiaries, and high-net worth individuals in a range of succession and trust disputes relating to executors’ and trustees’ duties, conflicts of interest, equitable remedies, family provision, and probate applications.*
