Biography

MADELEINE JOSEPH handles clients’ most important and challenging legal issues — wherever they arise. A former Supreme Court clerk, Maddy represents companies in high-stakes litigation at every level, especially in cases involving complex questions of administrative law or statutory interpretation. She also frequently counsels clients through sensitive and difficult regulatory and enforcement challenges.

Maddy is highly experienced in representing healthcare and life sciences companies — especially pharmaceutical manufacturers and distributors — in both litigation and advocacy matters. She also works frequently with major technology companies, especially on consumer protection and enforcement issues involving the Federal Trade Commission.

Maddy’s notable wins include:

  • Obtaining dismissal of a fraud suit brought against Cencora by United Healthcare Services Inc. in federal court in Minnesota, in which United Health Services sought hundreds of millions of dollars in damages. For the win, Maddy and the Sidley team were recognized by AmLaw Litigation Daily as Litigator of the Week runners up.
  • Achieving favorable resolution of a landmark suit brought under the Restore Online Shoppers’ Confidence Act by the FTC against a multinational electronic commerce company.
  • Briefing and arguing a successful opposition to motion to dismiss suit brought in federal court by pharmaceutical trade association challenging constitutionality of state law.
  • Representing Texas Medical Association in a series of four successful Administrative Procedure Act suits challenging the federal government’s implementation of the No Surprises Act.

Prior to joining the firm, Maddy served as a law clerk to Justice Elena Kagan of the U.S. Supreme Court, Judge Sandra Lynch of the U.S. Court of Appeals for the First Circuit, and Chief Judge Beryl Howell of the U.S. District Court for the District of Columbia.

Maddy received her law degree from Harvard Law School, where she was the book reviews editor for the Harvard Law Review.
