Panel 5 - Witness evidence in international arbitration: overrated, underestimated or simply misunderstood?

Is the “ideal” number of fact witnesses truly “0”? The current practice of using witness evidence in international arbitration has come under increasing scrutiny due to (i) questions regarding credibility and reliability of witnesses’ recollections, (ii) appropriate limits on the scope of witness statements, and (iii) diverse –and sometimes inconsistent –approaches to witness preparation across jurisdictions.
In this session organised by the Korea Chapter YMG, we will hear from both civil law and common law practitioners to tackle these difficult yet important questions and explore what could be the “ideal” approach to witness evidence in international arbitration.
