On June 8, 2026, the Consumer Financial Protection Bureau (CFPB) issued a Statement on Ability to Repay and Immigration Status, addressing creditors’ obligations under the Truth in Lending Act and Regulation Z, and the consideration of immigration status when assessing a consumer’s ability to repay.

On September 9, Sidley partners David Monteiro, Marketa Lindt, and Kristin Lee will join the American Bankers Association for “CFPB’s Statement on Ability to Repay and Immigration: A Deeper Dive.” The panel will discuss the interaction between immigration law and the CFPB’s guidance, as well as practical strategies for navigating the guidance alongside federal and state consumer protection and anti-discrimination laws.
