New AI & Cybersecurity Crackdown: What Indian Businesses Need to Know

Recent U.S. and EU laws are reshaping AI governance, data security, and compliance obligations, and Indian businesses handling cross-border data, IT, or outsourcing services must act now to avoid serious risk.
- The EU’s AI Act and NIS2 Directive recently came into force, and has extraterritorial reach. These impose strict cybersecurity, AI transparency, and incident reporting requirements, and non-compliance could result in heavy fines and personal liability for senior executives.
- In the U.S., as AI continues to take center stage, the U.S. government and the private sector continue to rely on NIST standards for AI governance and best practices. Recently NIST published cybersecurity standards and best practices as it relates to AI development and deployment. Indian companies doing business in the U.S. would be prudent to account for these standards as they develop and deploy AI systems. At the same time, U.S. States have taken the laboring oar on privacy/cybersecurity enforcement and regulation.
