Under the Biden Administration, OSHA proposed arguably the most expansive rule in its history – covering nearly all indoor and outdoor workers in temperatures at or above a heat index of 80 degrees Fahrenheit. The proposal was met with sharp criticism from the business community.
Following the change in Administration, many predicted that OSHA’s rulemaking efforts would come to a quick halt. But with a web of aggressive state laws cropping up to fill the void, we have seen growing movement toward continued rulemaking.
