Clean Water Act Rule Limits States' Power to Block Infrastructure Projects

On June 1, 2020, the U.S. Environmental Protection Agency (EPA) released its Clean Water Act Section 401 Certification Rule. The Rule, which becomes effective 60 days after publication in the Federal Register, will facilitate infrastructure development by narrowly construing the scope of states’ authority under Section 401 of the Clean Water Act (CWA, or the Act), 33 U.S.C. § 1251 et seq., to review projects that require a federal license or permit.
