ANDREAS BALSIGER BETTS advises on complex regulatory matters across the life sciences spectrum, drawing on his broad experience and in-depth knowledge of Swiss regulations, as well as the administrative procedures involved in manufacturing, promoting and selling medicinal products and medical devices. In addition, he advises on matters concerning compliance, administrative and criminal investigations, and government liability.
Prior to joining the firm, Andreas served as Head of Legal Affairs and a Member of the Management Board of Swissmedic, the Swiss Agency for Therapeutic Products. During his 15 years at the agency, he was responsible for establishing and maintaining the legal guidance for Swissmedic’s policies, procedures and practice, both strategically and on a day-to-day basis.
Andreas had a lead role in drafting the complete revision of the Swiss Federal Act on Therapeutic Products (TPA) and its ordinances, which came into force in January 2019. He represented Swissmedic in all of the parliamentary committee meetings in this context. As a result, he has a comprehensive understanding of the current legal framework, as well as extensive knowledge of the Swiss legislative processes at both the parliamentary and executive levels.
Under his leadership, the team represented Swissmedic in all court cases regarding administrative and penal decisions made by the agency against claims of liability and in Freedom of Information Act inquiries. Together with his division of specialized prosecutors, Andreas was also responsible for criminal prosecution within the remit of Swissmedic. Andreas also continuously represented Swissmedic at EMACOLEX (European Medicines Agencies Co-operation on Legal and Legislative Issues).
Earlier in his career, Andreas led one of the legal teams at the Swiss Federal Ministry of Finance where he was significantly involved in legislative work regarding the Federal Act on Public Procurement, as well as the first Swiss anti-money laundering legislation.
