Biography
LIV HERRIOT focuses her practice on representing and advising companies in high-stakes patent litigation and other complex intellectual property disputes. She works closely with companies on protecting innovation and managing intellectual property risk and disputes.
Liv’s practice spans litigation in district court, appeals to the Federal Circuit, and proceedings before the Patent Trial and Appeal Board, as well as strategic counseling tied to broader business objectives. She has extensive experience advocating for clients at every stage of litigation, from pre-suit investigations through trial and appeal. She is known for her ability to manage large and small case teams efficiently, coordinate with co-defendants, and serve as a trusted day-to-day adviser to clients facing bet-the-company disputes.
Liv works with a broad range of technologies, including hardware, software, telecommunications, financial services, standard essential patents, and consumer technologies. In addition to litigation, Liv advises clients on intellectual property risk management and licensing disputes.
Liv was named a Northern California Super Lawyers “Rising Star” for intellectual property litigation from 2015 through 2021. She is admitted to practice in California, before the U.S. Court of Appeals for the Federal Circuit, as well as multiple U.S. district courts.

United States Court of Appeals for the Federal Circuit
- Prepared brief for successful affirmance of district court’s order dismissing 243 claims as reciting ineligible subject matter under 35 U.S.C. § 101.
- Prepared brief for successful affirmance of PTAB order invalidating all challenged claims.
U.S. District Courts
- Managed trial team which obtained jury verdict of no infringement and invalidity with respect to four asserted software patents in the U.S. District Court for the Western District of Texas.
- Obtained dismissal of patent infringement action filed against software client in the U.S. District Court for the District of Delaware.
- Obtained dismissal of a four-patent infringement complaint because all claimed patent-ineligible subject matter under 35 U.S.C. § 101 in the U.S. District Court for the Central District of California.
- Obtained dismissal of a six-patent infringement complaint because all claimed patent-ineligible subject matter under 35 U.S.C. § 101 in the U.S. District Court for the Northern District of California.
