SHARON LEE’s practice focuses on patent and trade secret litigation matters in the life sciences and high tech industries. She has litigated in district court, the Patent Trial and Appeal Board, the International Trade Commission, and the U.S. Court of Appeals for the Federal Circuit. Sharon has represented clients in cases involving various technologies, including medical devices, consumer electronics, computer software, networks, e-commerce, and biotechnology. She has experience in all stages of litigation, including arguing Markman and dispositive motions in district court, examining fact and expert witnesses at trial, and arguing before the Patent Trial and Appeal Board and Federal Circuit. Sharon has been recognized as a “Rising Star” for intellectual property litigation by Super Lawyers (2017 – 2021).

Sharon’s representative matters include:
- Boston Scientific Neuromodulation Corp. v. Nevro Corp. – Representing Nevro in three cases in the District of Delaware involving over 25 patent and trade secret claims relating to spinal cord stimulation and implantable medical device technology. Core member of team representing Nevro in a series of IPR proceedings and appeals that successfully invalidated over 115 claims of nine patents, including all asserted claims of a foundational Boston Scientific patent that voided 84% of Boston Scientific’s total damages claim in the first Delaware case. Also represented Nevro in a jury trial that resulted in a verdict of noninfringement of two of four Boston Scientific patents.
- Intuitive Surgical, Inc. v. Auris Health, Inc. – Representing Auris Health, a subsidiary of Johnson & Johnson, in a series of IPR proceedings challenging the validity of multiple Intuitive Surgical patents asserted in the District of Delaware. After the PTAB instituted review, Intuitive Surgical voluntarily disclaimed all challenged claims of one of its patents.
- Omni MedSci, Inc. v. A Leading U.S. Consumer Electronics Company – Representing leading U.S. consumer electronics company in three patent infringement lawsuits brought against heart rate monitoring functionality on smartwatch. Argued at two claim construction hearings that resulted in the district court invalidating eight asserted claims for indefiniteness.
- Intellectual Ventures II LLC v. Great West Insurance Company – Represented Great West, a subsidiary of Old Republic International Corporation, in a jury trial in E.D. Tex. and successfully limited damages to less than 8% of plaintiff’s demand.
- Google LLC v. BlackBerry Ltd. – Represented BlackBerry at the Federal Circuit and in IPR proceedings in which multiple claims of BlackBerry’s network security patent was upheld as patentable.
- A Leading U.S. Consumer Electronics Company v. SightSound Tech. LLC – Successfully invalidated all challenged claims in two patents directed to electronic sale and transmission of music and video. Federal Circuit affirmed and denied SightSound’s requests for rehearing and rehearing en banc.
- Smartflash LLC et al. v. A Leading U.S. Consumer Electronics Company – Defended leading U.S. consumer electronics company in a six-patent case in E.D. Tex., including a jury trial, relating to purchase and digital rights management of content. The Federal Circuit found all asserted claims ineligible under § 101. Successfully invalidated all claims in seven patents (totaling more than 150 claims) in more than 40 CBM petitions. The Federal Circuit affirmed.
- Defended a major Korean electronics company in patent litigation related to user interface technology. Resulted in stipulation of non-infringement following a favorable claim construction order, which was affirmed on appeal.
Sharon maintains an active pro bono practice and has represented clients in cases involving veterans disability, copyright, asylum and Section 8 housing.
