Lawrence P. Fogel

LARRY FOGEL is an experienced litigator who represents companies and individuals in a diverse range of high-stakes litigation matters, with a focus on securities litigation, commercial disputes, and data privacy litigation. Larry has represented clients at the trial and appellate levels in federal and state courts across the country, including securities and shareholder derivative litigation, consumer class actions, and class actions under state privacy statutes. He has also represented clients in connection with government investigations and internal investigations. Larry’s efficient and pragmatic strategies have produced successful results for clients.

Representative matters include:

• Represented a global integrated resort company and senior executives in securities and shareholder derivative litigation in the U.S. District Court for the District of Nevada and won a motion for reconsideration of a motion-to-dismiss ruling, resulting in dismissal of all claims.
• Represented a Big Five technology company in a putative class action pursuant to the Illinois Biometric Information Privacy Act in Illinois state court, and successfully obtained dismissal of the complaint without prejudice, followed by plaintiffs voluntarily dismissing the case.
• Represented a major technology company in a putative BIPA class action and a related individual action in the Northern District of Illinois. After discovery, plaintiffs in both actions voluntarily dismissed the case with prejudice.
• Represents a financial institution in False Claims Act litigation in parallel proceedings in multiple jurisdictions.
• Represented a global integrated resort company in defense of federal securities litigation in the U.S. District Court for the District of Nevada and successfully obtained summary judgment, which was affirmed by the U.S. Court of Appeals for the Ninth Circuit.
• Represented a public company in defense of consumer class action in the U.S. District Court for the District of Arizona.
• Represented a healthcare technology company and successfully defeated class certification in putative class action brought under the Telephone Consumer Protection Act (TCPA) in the U.S. District Court for the Northern District of Illinois.
• Representing clients in non-public government investigations, including before the DOJ, SEC and CFTC.
• Secured dismissal of a putative securities class action against a multinational quick service restaurant company in the U.S. District Court for the Western District of Kentucky, which was affirmed by the U.S. Court of Appeals for the Sixth Circuit.
• Represented Chicago Loop Parking LLC (an asset owned by Morgan Stanley Infrastructure Partners) in an arbitration resulting in a $62 million judgment in favor of our client, which was contested in the Circuit Court of Cook County and affirmed by the Illinois Appellate Court.

Larry is a member of the firm’s SidleyWomen committee, and is also active in Sidley’s training, mentoring, and recruiting programs.

Outside of Sidley, Larry is committed to civic life and his community, including serving on the Partners Board of Urban Initiatives.

Larry is also committed to pro bono work. Larry was part of the Sidley team that represented clients in litigation against the State of Michigan contending that it had violated the federal Due Process and Equal Protection Clauses by excluding students in certain Detroit schools from access to literacy. This work received national attention and earned the Sidley team Public Counsel’s 2019 Pro Bono Award. Larry also represented a client at the U.S. Supreme Court in a case concerning the standard for evaluating as-applied challenges to method of execution. Larry has twice received the firm’s Thomas H. Morsch Award for Pro Bono Achievement.
