Biography

JONATHAN MITNICK focuses his practice on representing debtors, lenders, insurers, and sponsors in complex chapter 11 cases and proceedings, including prepackaged cases, 363 asset sales, mass tort bankruptcy cases, and fraudulent transfer litigation. He also has extensive experience representing buyers and sellers in mergers and acquisitions, including strategic internal restructurings and sale transactions designed to divest legacy liabilities, and advising borrowers and lenders in connection with complex financing transactions, including secured credit facilities, structurally senior credit facilities, and back-leveraged loans. 

Jonathan served as a judicial intern for Chief Judge Christopher S. Sontchi (Ret.) of the United States Bankruptcy Court for the District of Delaware, and for Judge Martin Glenn of the United States Bankruptcy Court for the Southern District of New York.

  • Certain Prospect Medical Holdings, Inc. physician-related debtor affiliates in its Chapter 11 filing in the United States Bankruptcy Court for the Northern District of Texas.
  • Merit Street Media, Inc., a Texas-based television and digital media company, in its Chapter 11 filing in the United States Bankruptcy Court for the Northern District of Texas.
  • DIP lender in connection with the Hooters restructuring.
  • A live entertainment venue in connection with evaluating strategic alternatives.
  • Boards of distressed companies in evaluating strategic alternatives.
  • Sellers and purchasers in transactions relating to assignments for the benefit of creditors (ABCs).

Community Involvement

Pro Bono

Jonathan has provided pro bono representation to nonprofit organizations and small businesses, including Joyeux Foundation US, which provides job training and employment to disabled individuals through cafés in New York City staffed by disabled individuals, and New York Immigration Coalition, an umbrella policy and advocacy organization representing 200+ immigrant and refugee rights groups.
