HRSA Releases 340B Administrative Dispute Resolution Final Rule

On December 10, 2020, the U.S. Department of Health and Human Services (HHS) Health Resources and Services Administration (HRSA) released a final rule that sets forth the requirements and procedures for the 340B Program’s administrative dispute resolution (ADR) process (the Rule). The Rule finalizes a proposed rule HRSA published on August 12, 2016, but that was subsequently removed from the HHS Regulatory Agenda in 2017. In the Rule, HRSA states that it “did not formally withdraw” the proposed rule “but rather left it open as a viable option.” HRSA states that it considered the comments received in response to the proposed rule in developing the Rule. The Rule was published in the Federal Register on December 14, 2020, with an effective date of January 13, 2021. The final rule comes more than four years after HRSA published a 340B ADR proposed rule and at a time when 340B-related litigation has recently arisen.

The remainder of this Update summarizes the Rule and certain changes compared to the proposed rule. In summarizing the Rule, we are not endorsing the positions or interpretations HRSA has taken.
