U.S. DOJ and HHS-OIG Scrutiny of Telehealth Services and Arrangements at an All-Time High

Last week, the U.S. Department of Health and Human Services, Office of Inspector General (HHS-OIG), took the significant step of issuing a Special Fraud Alert as a warning to providers to exercise caution when entering into arrangements with telehealth companies. In a coordinated press release, the Department of Justice (DOJ) announced another wave of enforcement actions to combat telehealth fraud. These announcements come on the heels of recent industry crackdowns (discussed here). The government’s message is clear: Telehealth companies, healthcare providers, and medical products and technology companies that enter into arrangements with telehealth companies are the subject of enhanced enforcement scrutiny and should take steps to evaluate and reduce their key compliance risks.
