Biography
GILBERT SMOLENSKI focuses his practice on representing and advising clients in high-stakes intellectual property disputes. He works closely with companies to advise them on various strategies to protect innovation and make informed decisions with respect to intellectual property risk and disputes. His practice spans litigation in district court, appeals to the Federal Circuit, and proceedings before the Patent Trial and Appeal Board, as well as strategic counseling tied to broader business objectives.
Gilbert works with a broad range of technologies and regulated products. For example, Gilbert has represented clients that are in the medical device, software, hardware, and renewable energy sectors. He frequently advises emerging and established companies on portfolio development, global enforcement strategy, and intellectual property risks in transactions.
Gilbert received his law degree from Wake Forest University School of Law, graduating magna cum laude and Order of the Coif. While in law school, Gilbert served as a judicial extern for The Honorable Mark Davis of the North Carolina Court of Appeals. He also served as a notes and comment editor for the Wake Forest Law Review and received an award from the law school’s faculty at graduation for demonstrating the highest standards of character, leadership, and scholarship. While obtaining his undergraduate mechanical engineering degree from Clemson University, Gilbert worked for a leading medical device company where he worked on various design projects related to next generation medical devices.
