New Challenges to International Data Transfers in Cross-Border Investigations

Government investigations into multinational corporations have always raised challenges in terms of document collection, translation, review, and production. Now those challenges are compounded by the rapid proliferation and expansion of different data protection regimes around the world.
According to Gartner, Inc., in 2020 around 10% of the world’s population was covered by a personal data privacy regulation. By 2023, that figure is expected to reach 65%. For counsel who must be prepared to defend companies across multiple jurisdictions, potential conflicts of law over data privacy issues are already a fact of life. In the coming years, those potential conflicts will only deepen in both frequency and scale.
