Biography

JOSEPH OSCHRIN focuses his practice on international trade and customs law. Joe advises companies on all aspects of U.S. customs law and the importation of merchandise into the United States. He counsels clients on duty mitigation strategies, duty reduction projects, and the use of foreign-trade zones, as well as the application of free trade agreements and USMCA preference rules.

Prior to joining Sidley, Joe served as an Attorney-Advisor with U.S. Customs and Border Protection (CBP) in the Office of Trade, Regulations and Rulings Directorate. In that role, he worked on administrative rulings, internal advice, protests, and other guidance for CBP and the Department of Homeland Security, and assisted other federal agencies on trade-related issues. He also supported CBP’s oversight of licensed customs brokers and the Customs Broker License Exam.

Joe regularly assists clients with compliance reviews, prior disclosures, and the design and implementation of customs compliance improvement plans. His experience includes advising on Section 232 and Section 301 measures and other Executive Branch tariff actions, including Section 201 investigations, AD/CVD scope issues, and USTR investigations. He also has experience with FDA-related import issues, including pharmaceuticals and medical devices, such as Nairobi Protocol importations. Joe works closely with clients in preparing protests, managing first sale strategies, and addressing customs broker licensing and customs business questions.

Representative Matters

  • Preparing detailed disclosure statements and customs compliance improvement plans for importers.
  • Analyzing the impact of Section 232 and Section 301 measures, as well as other Executive Branch tariff implementations and investigations, on clients’ supply chains and duty exposure.
  • Assisting clients with duty reduction projects and strategies to mitigate additional duties, including through first sale structures and use of foreign-trade zones.
  • Supporting clients in connection with Section 201 investigations and related advocacy.
  • Advising on free-trade agreement and USMCA qualification and preference claims, country of origin determinations, marking requirements, and classification of merchandise.
  • Counseling on AD/CVD scope inquiries and related customs issues.
  • Assisting clients and customs brokers with licensing questions and customs business requirements, including helping clients pursue customs broker licenses.
  • Addressing FDA-related import issues, including contributing to briefing on pharmaceutical importations.
  • Advising on auto-related tariff issues, including the application of Section 232 to metals used in automotive production.
