On September 30, 2026, Cal. Gov. Gavin Newsom (D) signed S.B. 1111, clarifying that California’s right-of-publicity statute covers digital replicas (realistic computer-generated representations of a person’s voice or likeness). Knowingly using a person’s digital replica on products or in ads without consent is actionable under the statute’s private right of action. The prior presumption favoring employers whose ads incidentally use an employee’s likeness is removed.

On September 30, 2026, Cal. Gov. Gavin Newsom (D) signed S.B. 1000, an urgency measure amending the California AI Transparency Act. The amendments extend the Act to providers of all publicly accessible generative AI systems by removing the 1,000,000-monthly-user threshold. Providers must offer a disclosure verification tool in place of the AI detection tool, and must embed provenance disclosures in content their systems alter, not just content they create. The amendments also eliminate the duty to offer a visible disclosure option, narrow the exemption for non-user-generated entertainment to video games, and temporarily exempt assistive-technology systems.

On September 30, 2026, Cal. Gov. Gavin Newsom (D) signed S.B. 951, adding AI-specific content to Cal/WARN Act mass layoff notices. When a mass layoff, relocation, or termination is caused in whole or substantial part by AI or other automated technology replacing jobs, the notice must identify the layoff as a technology displacement and state the number and types of affected positions, the job functions being automated, and the type of technology responsible. The state will publish notice summaries online.

Employers cannot rely solely on an ADS for discipline or termination, must have a human corroborate decisions that primarily rely on ADS output, and must give affected employees written notice and, on request, a description of their data used. Employers also cannot use ADS to infer protected status or to penalize workers for exercising legal rights.

Attorneys cannot delegate the practice of law to generative AI tools, or enter confidential or other nonpublic information into such a tool unless access to that information is restricted to the attorney and authorized persons obligated to keep the information confidential. Attorneys using these tools must also take reasonable steps to verify the accuracy of outputs, including citations, and correct erroneous or hallucinated output.

On September 30, 2026, Cal. Gov. Gavin Newsom (D) signed S.B. 503, addressing bias in AI clinical decision support. Developers and deploying health facilities and medical practices must make reasonable efforts to identify systems with a known or reasonably foreseeable risk of biased impacts based on protected characteristics. Developers must try to mitigate that risk and give deployers documentation, including on training data. Deployers must regularly monitor these systems and take reasonable steps to reduce that risk.
