Biography

DANIEL BURKHART focuses his practice on various secured and unsecured leveraged finance transactions and debt restructurings. He regularly represents public and private company borrowers, private equity sponsors and direct lenders on acquisition financings, asset-based financings, cash-flow based financings and subscriptions, and NAV and hybrid financings. Daniel also has significant experience in the financing and strategic elements of in-court and out-of-court restructurings, including complex liability management, workouts, and debtor-in-possession financing transactions.

Daniel’s financing experience extends across a wide variety of industries, including: aerospace, automotive, food and beverage, healthcare (including corporate practice of medicine), insurance, logistics, manufacturing, retail, technology services, and telecommunications.

Daniel was recognized in Secured Finance Network’s 2025 “40 Under 40 Awards.” Daniel’s work has also earned him recognition in Best Lawyers in America: Ones to Watch 2026 for Banking and Finance Law and Mergers and Acquisitions Law.

Prior to becoming a lawyer, Daniel worked for a national accounting firm and a tier-one automotive supplier.

  • Special committee of the board of directors of Nordstrom, Inc. (NYSE: JWN) in its US$6.25 billion acquisition by certain members of the Nordstrom family and El Puerto de Liverpool, S.A.B. de C.V.
  • HealthCare Royalty in the negotiation of a US$250 million non-dilutive note purchase agreement with OPKO Health, Inc. (NASDAQ: OPK) secured by OPKO’s profit share payments from Pfizer Inc. received pursuant to its license agreement relating to NGENLA™, a once-weekly treatment marketed to treat pediatric growth hormone deficiency.
  • TowerBrook Capital Partners, L.P. in multiple transactions, including its strategic investment in Amylu Foods and its acquisition of CBTS from altafiber (formerly doing business as Cincinnati Bell).
  • ICON Aircraft, Inc. in its filing for Chapter 11 protection in Delaware, citing more than US$170 million in debt.
  • BowFlex Inc., a global marketer, developer, and manufacturer of health and fitness equipment that was sold under several canopy fitness brands, including BowFlex, Nautilus, Schwinn and JRNY.
  • Arthur J. Gallagher & Co. in its US$13.45 billion acquisition of AssuredPartners.
  • Grove Collaborative, Inc. (NYSE: GROV) in connection with their corporate credit facilities.
  • Nice-Pak Products, Inc. in connection with the refinancing of their corporate credit facilities.
  • Avantax, Inc. in its acquisition by Cetera Holdings.
  • H.I.G. Capital in the sale of Eruptr.
  • Publicly traded specialty insurance company in a secured credit facility in connection with Up-C SPAC transaction.
  • Private capital investor in a senior secured convertible note purchase and preferred equity investment transaction with a commercial software company that provides integration platform as a service tools.
  • Private capital investor in a senior secured convertible note purchase and preferred equity investment transaction with a nanotechnology company that develops and manufactures quantum dot materials for display products.
  • Lead arranger and administrative agent in a secured credit facility in connection with the asset acquisition of the branded frozen pasta division of a publicly traded food and beverage processing company.
  • Lead arranger and administrative agent in revolving credit and term loan facilities for a publicly traded hotel, theater, and entertainment company.
  • Lead arranger and administrative agent in an unsecured credit facility for a publicly traded food and beverage company.
  • Lead arranger and administrative agent in an unsecured credit facility for a publicly traded national trucking and logistics company.
  • Lead arranger and administrative agent in an unsecured credit facility for a leading manufacturer of outdoor power equipment.
