James Daher

JAMES DAHER advises clients on a broad range of international trade, economic sanctions, export controls, and national security matters. His practice includes counseling U.S. and multinational companies on compliance with economic sanctions administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC), the Export Administration Regulations (EAR) administered by the U.S. Department of Commerce’s Bureau of Industry and Security (BIS), and the International Traffic in Arms Regulations (ITAR) administered by the U.S. Department of State’s Directorate of Defense Trade Controls (DDTC). He also advises clients on U.S. inbound and outbound investment restrictions.

James advises clients on the international trade and national security aspects of mergers and acquisitions, financings, restructurings, investments, and other commercial transactions. His transactional practice includes conducting regulatory diligence, assessing and allocating sanctions, export-control, anti-corruption, and national security risks, and advising on compliance considerations arising before and after closing. In addition, James represents clients in filings and reviews before the Committee on Foreign Investment in the United States (CFIUS) and advises on the evolving U.S. outbound investment regime.

James also assists companies with the development, implementation, and enhancement of risk-based trade compliance programs. His work includes advising on policies, procedures, and internal controls designed to address sanctions and export-control risks; assessing compliance gaps and potential violations; and counseling clients on remediation and other measures to strengthen compliance frameworks.

James counsels clients in connection with internal investigations and potential regulatory violations and represents clients in matters involving U.S. federal agencies. He works with companies to assess legal and compliance risks, develop practical responses to identified issues, and navigate regulatory inquiries and enforcement considerations.
