Product liability cases involving the same product often are coordinated for pretrial proceedings before a single MDL judge for federal cases, and before a single state court judge for state court cases in certain jurisdictions (e.g., California, Delaware, New Jersey, New York, Philadelphia County). Our lawyers have developed and implemented strategies for handling and resolving coordinated proceedings in all of these jurisdictions. For example, we employ removal and transfer techniques to ensure that the maximum number of cases possible are coordinated in such proceedings, to reduce duplication and inconsistency. We also develop and successfully implement novel approaches to dispose of cases due to discovery violations. In addition, we have extensive experience with those plaintiffs’ firms that frequently are part of representative steering committees and are able to negotiate pretrial issues with them successfully on behalf of our clients.
