Biography

JACK RAFFETTO focuses his practice on environmental litigation, particularly in connection with contamination cleanup and government enforcement matters. Jack has assisted clients in connection with Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or Superfund) matters, including complex allocation issues, and in complex civil litigation related to contaminated sites. Jack also represents clients in Clean Air Act enforcement matters, Clean Water Act litigation, litigation challenging environmental regulations, and in connection with environmental aspects of transactions.

Jack’s representative experience includes:

  • A large international chemical company in connection with remediation of a CERCLA mega-site, viewed as a model nationwide for how to address a large contaminated site responsibly, reasonably, and efficiently.
  • An international chemical company at one of its most important Superfund sites by providing analysis and advocacy concerning the scope of “arranger liability” under CERCLA and issues concerning successor liability of entities purchasing assets from companies with environmental liabilities.
  • A large industrial company in responding to and negotiating with EPA regarding requested clean-up at a delisted Superfund site.
  • A large US chemical company responding to an indemnification claim in connection with a long-standing CERCLA site in New England.
  • An oil pipeline and terminal company in connection with alleged liability related to site contamination in New York.
  • A major international fuel producer in connection with enforcement of alleged violations of the Clean Air Act Risk Management Program.
  • California Fuels and Convenience Alliance in litigation against the California Energy Commission regarding the agency's regulations to implement SB X1-2 (“the California Gas Price Gouging and Transparency Law”).
  • A power development company on a contaminated site in Michigan.
  • A large e-commerce company on environmental remediation of real estate holdings and acquisitions.
