President Trump Signs Four Executive Orders Intended to Lower Drug Prices

President Trump announced four Executive Orders on July 24 that direct the Secretary of Health and Human Services (HHS) to implement sweeping policy changes to reduce prescription drug prices and out-of-pocket costs, subject to important limitations. Three of the Executive Orders were issued soon after the President’s announcement, and a fourth will be held for 30 days pending discussions between the Administration and the pharmaceutical industry. The Executive Orders seek to revive certain policy changes previously proposed by the Trump Administration aimed at lowering drug prices. A number of the proposals create significant issues with regard to whether they are consistent with existing statutory and regulatory authority, with litigation likely if such proposals are finalized and implemented.
