August's Notable Cases and Events in E-Discovery

This Sidley Update addresses the following recent developments and court decisions involving e-discovery issues:

  1. a U.S. Court of Appeals for the District of Columbia Circuit ruling that the district court had awarded unauthorized costs associated with predicate and ancillary steps of discovery production that did not fall within the allowable scope of 28 U.S.C. § 1920
  2. a U.S. District Court for the Northern District of California decision noting the contentious nature of discovery between the parties and granting in part but significantly reducing the fees awarded defendant as sanctions for plaintiff’s conduct in connection with various discovery disputes
  3. a U.S. District Court for the District of Kansas order denying all but one of plaintiff’s various discovery requests, holding, among other things, that intracompany instant messages not stored by default need not be produced
  4. a U.S. District Court for the Western District of Virginia decision granting in part defendants’ motion to compel responses about the plaintiff’s efforts to enforce its mark but limiting the scope of such responses given plaintiff’s widespread enforcement activity
