FTC Issues Civil Penalty Notice to 700 Companies Challenging Substantiation For Product Claims

Today the Federal Trade Commission (FTC) issued a press release announcing that it is issuing “notices of penalty offenses” to almost 700 marketing companies, challenging the bases that the companies use for making “product claims,” particularly “health claims.” The FTC stated that it plans to use its penalty offense authority, which allows it to seek up to US$50,120 per violation, to “remind advertisers of the legal requirement” “to have a reasonable basis to support objective product claims” and “to deter them from making deceptive claims in the future.” The commission voted 3-1 to approve the notices on March 31, 2023, with Commissioner Wilson dissenting. This sweeping action targets major manufacturers and marketers across numerous industries selling consumer products including dietary supplements, homeopathic products, food, drugs, and devices.
