Practicalities of Aircraft Leasing: Repossession

Aircraft repossession demands early engagement of experienced legal counsel and coordination with local counsel in relevant jurisdictions as repossession laws and procedures vary widely and may require court involvement. Specialized repossession companies also need to be engaged to handle the practicalities and logistical aspects of repossession. At the same time, key transaction and registration documents need to be collected and analyzed to assess rights and the required steps to enforce repossession. By integrating legal, operational, and documentary inputs, stakeholders can develop an effective strategy for repossession and related actions, including deregistration, export, and eventual resale or re-leasing of the relevant aircraft. As timing is often critical, successfully repossessing aircraft largely depends on how quickly and comprehensively information can be gathered and organized during the initial stages.
