Sidley is representing electric vehicle maker Waev Inc. in a first-of-its kind legal action against the U.S. Department of the Treasury challenging the IRS rule that excluded the company’s low-speed GEM line of electric cars from the Inflation Reduction Act’s electric vehicle tax credit program. California-based Waev is also challenging a 50-year-old Environmental Protection Agency regulation defining a “motor vehicle” as part of the dispute.
