We bring value to our clients in the following ways:
- Integrated services. Our team combines nationally recognized regulatory counsel with premier enforcement and litigation capabilities across the full healthcare product and services lifecycle — from development and market access to post-market compliance and government defense. Our regulatory and enforcement lawyers work in tandem, ensuring that clients receive advice grounded in both a nuanced understanding of the current enforcement environment and deep regulatory experience. This integration allows us to seamlessly address matters where regulatory, commercial, and enforcement risks intersect.
- Cross-border and cross-sector reach. We serve healthcare and life sciences clients across the U.S. and globally, with lawyers coordinating on matters spanning multiple jurisdictions. From China anti-dumping investigations and cross-border M&A to global compliance program integration, our team provides coordinated counsel that reflects both transnational regulatory frameworks and local law and practice.
- Market-leading enforcement and litigation. Our healthcare enforcement and litigation team has represented life sciences and healthcare companies in hundreds of False Claims Act matters over more than three decades — securing government declinations, favorable dismissals, and jury verdicts in some of the most high-profile and high-stakes government investigations in the country. Clients facing bet-the-company civil, criminal, and administrative actions consistently turn to our team.
- Deep industry experience across the healthcare ecosystem. Our team advises the full spectrum of healthcare clients, including major hospital systems, pharmaceutical and medical device manufacturers, specialty providers, telehealth companies, clinical laboratories, private equity investors, and trade associations on complex regulatory, transactional, and enforcement matters. This breadth allows us to provide practical, strategic counsel informed by a nuanced understanding of the interdependencies among providers, suppliers, manufacturers, payors, and investors across the healthcare supply chain.
- Drug Pricing & Inflation Reduction Act Advisory. Recognized as go-to counsel on prescription drug pricing, the team has advised more than two dozen pharmaceutical companies, development-stage companies, investors, and trade associations on strategy and compliance related to the Inflation Reduction Act and Most-Favored-Nation pricing reform, among the most consequential healthcare legislation since the Affordable Care Act, while also counseling manufacturers on government price reporting programs, 340B Drug Pricing Program obligations, and state drug price transparency laws.

Our work; representative matters
Our healthcare lawyers defend clients in government investigations; try civil cases; counsel clients on pricing, reimbursement, fraud and abuse, compliance, HIPAA/HITECH privacy, transparency, and antitrust issues; advocate on behalf of clients before Congress and regulatory agencies; and help assess regulatory risk in transactions.
A sampling of representative experience includes:
- Secured a landmark full defense verdict for Novo Nordisk in a three-week False Claims Act (FCA) jury trial — the first-ever pharmaceutical defense verdict in an FCA jury trial — defeating claims that patient assistance programs and physician relationships violated Anti-Kickback Statutes and resulted in fraudulent government healthcare claims, with the jury deliberating less than four hours before clearing the company on all six counts.
- Won a series of landmark federal court victories on behalf of the Texas Medical Association challenging the government's implementation of the No Surprises Act, achieving nationwide relief for physicians and emergency healthcare providers and shaping federal regulation of patient billing.
- Advised GE HealthCare across a range of high-stakes matters, including defense of two China-initiated trade investigations targeting X-ray tubes, a $2.3 billion acquisition of medical imaging software company Intelerad, and a successful regulatory challenge for its Alzheimer's diagnostic imaging agent Vizamyl.
- Obtained a full dismissal of a False Claims Act lawsuit targeting Jazz Pharmaceuticals' flagship narcolepsy drug Xyrem, with the court agreeing with Sidley's arguments on the public disclosure bar and constitutional challenges, after previously securing a DOJ declination to intervene
- Representing the leading U.S. pharmaceutical trade association on a landmark overhaul of voluntary industry principles governing speaker programs and business courtesies to physicians — the first major shift of its kind — while also advising on significant drug pricing litigation and advocacy related to the 340B Drug Pricing Program and Inflation Reduction Act strategy on behalf of the broader pharmaceutical industry.
- Lawyers in our European, Asian, and U.S. offices represented an international device manufacturer in implementing a global privacy program which allows the business freely to transfer health data globally while meeting national privacy law requirements.
