CMS Proposes New Medicare Coverage Pathway for Breakthrough Devices and Regulatory Definition of “Reasonable and Necessary”

On September 1, the Centers for Medicare & Medicaid Services (CMS) published in the Federal Register a proposed rule1 that would establish (1) a new coverage pathway for “innovative technology” and (2) a regulatory definition for “reasonable and necessary” determinations for purposes of Medicare coverage. As proposed, the new coverage pathway for innovative technology would apply only to “breakthrough devices,” but the proposed “reasonable and necessary” standards would apply more broadly. CMS specifically seeks comments on a number of important issues related to these proposals, including whether the new coverage pathway for innovative technology also should include certain — or all — diagnostics, drugs, and/or biologics; whether other, existing Medicare coverage pathways should be revised; and ways to implement the proposed regulatory standards for “reasonable and necessary” determinations. Comments to the proposal are due November 2, 2020.
